This Disclaimer applies to the SWMS Generator platform at swmsgenerator.com.au, operated by Bookmint Pty Ltd ("we", "us", "our"), ABN 58 623 823 594. It should be read together with our Terms and Conditions and Privacy Policy, which contain the operative terms governing your use of the platform. If anything in this Disclaimer conflicts with the Terms and Conditions, the Terms and Conditions prevail.
The information, tools and documents available on or through the platform are provided for general information and to assist you in preparing workplace safety documentation. They are not legal, professional, engineering or safety advice, and they are not a substitute for the judgement of a competent person with knowledge of your actual site, workers, plant and conditions.
If you are unsure about your work health and safety obligations, consult a qualified WHS professional, your industry association, or your state or territory WHS regulator.
Documents produced through the platform — including Safe Work Method Statements, site inductions and related safety documents — are drafted by artificial intelligence from the information you enter. AI-generated content can be inaccurate, incomplete, out of date, or inappropriate for your circumstances. It may omit hazards, misstate control measures, or reference requirements that do not apply to your work.
Every document produced through the platform is a draft and a starting point. You must review, correct and approve it before it is used, issued to workers, submitted to a principal contractor or client, or relied on as a record. Do not treat a generated document as complete or compliant simply because it was generated.
Under the Work Health and Safety Act 2011 and Work Health and Safety Regulation 2011 (and equivalent legislation in each State and Territory), the duty to prepare, implement, review and retain an SWMS for high-risk construction work rests with the person conducting the business or undertaking. Using the platform does not transfer, share or discharge that duty.
You are solely responsible for ensuring that each document:
We do not review your documents, and we do not warrant that any document produced through the platform satisfies any legal, regulatory, contractual or client requirement.
The platform allows you to generate site induction content, collect worker acknowledgements and quiz responses, and collect electronic signatures on documents. These features create records at your direction. They do not verify a person's identity, qualifications, licences, competency, fitness for work or understanding of the content.
A completed induction or signature record is evidence that a person worked through the content you supplied and acknowledged it electronically. It is not a substitute for the site-specific induction, supervision, training and verification of competency that the legislation and your own systems may require. You are responsible for deciding whether an electronic record is adequate for your compliance, contractual or client purposes.
We make reasonable efforts to keep the platform's templates, activity libraries and reference content accurate and current. However, laws, regulations, codes of practice and industry standards change, and we do not guarantee that any content on the platform is complete, accurate or up to date at the time you use it. You should verify current requirements with the relevant regulator or a qualified professional.
The platform may contain links to third-party websites, regulators, standards bodies or resources. We provide these for convenience only. We do not control, endorse or accept responsibility for the content, accuracy or availability of any third-party site, and your use of it is subject to that site's own terms.
Your use of the platform, and of any information, document or record produced through it, is at your own risk. To the maximum extent permitted by law, and subject to the Australian Consumer Law and to the Terms and Conditions, Bookmint Pty Ltd and its directors, officers, employees and affiliates exclude all warranties, express or implied, and all liability for any loss, damage, injury, penalty or regulatory action arising from your use of or reliance on the platform or anything produced through it.

Nothing in this Disclaimer excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
We may update this Disclaimer from time to time. Updates are posted on this page with a revised "Last updated" date. Continued use of the platform after a change takes effect constitutes acceptance of the updated Disclaimer.
